Phase II Clearinghouse: CDL Downgrades Now Automatic

The End of the "Grey Area" for Prohibited Drivers

The full implementation of Phase II of the Drug and Alcohol Clearinghouse is now in full swing. As of this year, State Driver Licensing Agencies (SDLAs) are no longer just receiving information; they are required to act on it immediately.

The Automatic Downgrade: When a driver is marked as "Prohibited" in the federal Clearinghouse (due to a positive drug test or a refusal), the FMCSA automatically notifies the driver's state of licensure. The state is then required to downgrade the CDL to a non-commercial status within a very short window.

To regain commercial driving privileges, drivers must complete the formal Return-to-Duty (RTD) process with a Substance Abuse Professional (SAP). Driving on a downgraded license will result in severe penalties for both the driver and the motor carrier.
